Blue Coding provides nearshore software development staffing and outsourcing services, including connecting clients with vetted software developers and engineering talent. Our services may include:
• Talent matching and placement of software developers
• Nearshore team augmentation and managed development services
• Consulting and project-based software development
• Related professional and advisory services
The specific scope, deliverables, fees, and terms of any engagement will be set out in a separate Master Service Agreement (MSA), Statement of Work (SOW), or other written agreement between Blue Coding and the client.
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Site by, any third party. You must not:
• Use the Site in any way that violates applicable local, national, or international laws or regulations
• Transmit any unsolicited or unauthorized advertising or promotional material
• Attempt to gain unauthorized access to any part of the Site or its related systems
• Introduce any viruses, malware, or other harmful material to the Site
• Reproduce, duplicate, copy, or resell any part of the Site without our express written permission
The Site and its original content, features, and functionality are and will remain the exclusive property of Blue Coding and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Blue Coding.
Any intellectual property rights in work product created specifically for a client under a separate written agreement will be governed by the terms of that agreement.
In the course of our business relationship, each party may have access to confidential information belonging to the other. Both parties agree to keep such information confidential and not to disclose it to any third party without prior written consent, except as required by law. Specific confidentiality obligations will be detailed in any applicable NDA or MSA.
The Site and its content are provided on an “AS IS” and “AS AVAILABLE” basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Blue Coding does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, Blue Coding, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Site or our services.
In no event shall our total liability to you for all claims exceed the amount paid by you to Blue Coding in the twelve (12) months preceding the claim, or one hundred US dollars ($100), whichever is greater.
The Site may contain links to third-party websites or services that are not owned or controlled by Blue Coding. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites. These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Florida.
We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the “Last Updated” date.
